
CSDA
End User License Agreements (EULAs)
EULAs ensure that the U.S. government and its partners can share and use the data, including derived products, in accordance with agreements with commercial partners for various scientific applications.
NASA’s Commercial Satellite Data Acquisition (CSDA) Program requires government-defined End User License Agreements (EULAs) for all data products acquired from commercial partners for non-commercial use. These EULAs ensure that the U.S. government and its partners can share and use the data, including derived products, in accordance with agreements with commercial partners for various scientific applications. The minimum data rights specified in these agreements apply across all phases of the CSDA Program.
US Government
- The data purchased is shareable with all portions of the U.S. government defined under Title 5 U.S.C. 101-105; the Executive Office of the President (EOP), members of Congress, and congressional staff involved in the oversight of the entities identified in Title 5; state and local governments, territories, and tribal authorities within the U.S.; non-governmental organizations and/or non-profit organizations working for the purpose of the aforementioned entities; contractors, subcontractors, partners, and/or grantees supporting the aforementioned entities in execution of their contracts.
- Commercial satellite data products available through NASA’s CSDA program and derived products generated using data available through NASA’s CSDA program may not be sold or used for revenue generating purposes.
- Authorized users may generate and share unlimited copies of the data as long as they are shared among the qualified groups identified above.
- Users may generate and share unlimited value-added products from the data. The vendors’ copyright markings and copyright metadata must be preserved.
- Users may generate and share unlimited derived products from the data. The vendors’ copyright markings and copyright metadata must be preserved
US Government Plus
- The data purchased is shareable with all portions of the U.S. government defined under Title 5 U.S.C. 101-105; the Executive Office of the President (EOP), members of Congress, and congressional staff involved in the oversight of the entities identified in Title 5; foreign governments, intergovernmental entities, and International Defense and Coalition Partners for U.S. government purposes; state and local governments, territories, and tribal authorities within the U.S.; non-governmental organizations and/or non-profit organizations working for the purpose of the aforementioned entities; contractors, subcontractors, partners, and/or grantees supporting the aforementioned entities in the execution of their contracts.
- Commercial satellite data products available through NASA’s CSDA program and derived products generated using data available through NASA’s CSDA program may not be sold or used for revenue generating purposes.

Public EULA
- The data is purchased with the expectation it will be disseminated freely and openly to the public. Data and associated information publicly disseminated does not become public domain.
- Users may generate and share unlimited value-added products from the data, but the vendor’s copyright markings and metadata must be preserved.
- Users may generate and share unlimited derived products from the data. Vendor copyright markings should be included as appropriate.

- Request data access by completing the authorization request form at: https://csdap. earthdata.nasa.gov/signup/.
Definitions
Licensed Material
The data, metadata, and products provided by Licensor that are delivered or otherwise made available for the Licensee’s use as set forth in the agreement. Licensed Material strictly applies to the forms, formats, and other supporting data as received by Licensee.
Value-Added Product
The term value-added product applies to work that is created when a Licensed User modifies Licensed Material, be it through technical manipulation, addition of data, or both, where the principal features and characteristics of the source Licensed Material are retained in the work and are extractable through technical means. Value-added products created from Licensed Material received under this agreement will be considered as Licensed Material.
Derived Product
The term derived product refers to work that is created when a Licensed User exploits Licensed Material in a manner that irreversibly modifies and uncouples the work from its source, such that extraction of the principal features and characteristics of the source Licensed Material is impracticable. Digital elevation models are not treated as derived products. Derived products are not considered Licensed Materials.

All visual representations of data should be marked with a copyright statement which for the Program is:
- For data products: “© YYYY. All rights reserved.” (e.g.: “© Spire Global, Inc. YYYY. All rights reserved.”)
- For derivatives: “Includes copyrighted material of . All rights reserved.” (e.g.: “Includes copyrighted material of Spire Global, Inc. All rights reserved.”)
- A joint copyright notice may be used as appropriate.
- These statements are available for each vendor on the website (e.g., https://science.nasa.gov/earth-science/csda/vendor-airbus-us/)
- We also ask that that an acknowledgment be included: “This work used the data made available through the NASA Commercial Satellite Data Acquisition (CSDA) Program.”
